>> and there was a man with his hip completely displaced, like a war zone. there was another man next to him who was bleeding. >> i was going oh, my god. i hope it was -- i hope nobody got really severely hurt. >> you could hear the tables smashing into each other an people were actually screaming. >> reporter: this man works across the street from the cafe and says the driver stayed in his car for a while. apparently he just stayed in the car. it looked like everyone else on the ground like someone was twitching so they were in way worse shape than he was. >> sky 7 hd caught the moment when the driver was escorted by police to another car to be questioned. police say alcohol was not a factor. >> and a man in his 90s was attempting to parallel park in front. restaurant he accidentally hit the acceleration instead of the brake, thus pushing the car up on to the curb and into the front of the restaurant.

>> five people were injured and one critically. >> we've had one that is critical. we have three that were minor and then one was the walking wounded. the people that had major injuries were transported to stanford hospital. >> now here's the breakdown. one woman and four men were sent to the hospital. according to stanford, three of them will be discharge tonight. two of them will remain in the hospital overnight with broken bones and all of them with non-life-threatening injuries. i'm live in palo alto, lyanne melendez, abc 7 news. >> a new senate report just released this afternoon on a new bay bridge construction project suggests that caltrans over looked criticism and had some serious problems with transparency. several engineers who complained to caltrans management about problems with welding work say they were let go because of their complaints. the report also found problems with the bridge construction revealed by the media, not by

kra caltrans. director says that report was flawed because it doesn't include issues that been investigated, reviewed and resolved such as the welds. he did admit that the agency could have communicated better based on how decisions were made. nobody was released from the project simply because of complaining. those claims of retaliation will be investigated. the report comes the same day a panel of independent engineers found the bridge did meet safety standards. >> this evening workers are showing us the racist messages scrolled on their lockers. abc 7 news reporter vick lee spoke to the employees this afternoon. vick? >> reporter: you'll recall in december a group of black b.a.r.t. workers sued b.a.r.t. claiming that they work in a hostile environment and that they were being discriminated against in promotioned. we've learned that last month three black maintenance workers

with the targets of racial graffiti in the locker room. we spoke to one a while ago and another b.a.r.t. worker, a floor person in the maintenance shop, both of who spoke about the latest incident and say they are scared to work alone at night because of this death threat. >> i walked in, and it was written on my locker, you know, my name and the "n" word. >> maintenance workers rudolph johnson was the target of the racial graffiti june 27. someone scrawled these offensive words on his locker here at oakland maintenance shop facility. when johnson went to a supervisor he was told to go to another manager because he was too busy with other things. johnson says he's been a target before, the first time was two years ago. >> i was picked up and forced into a trash can and then tooken out of the trash can an placed on a table. >> johnson says b.a.r.t. force

him and two others whose lockers were defaced to go back to work even though the investigation continued. joseph montgomery has been with b.a.r.t. 18 years. he says the pattern of racism continues unabated. >> we've had a lot of racial discriminatory actions brought against african-americans, and when we reported to the management, they just sweep it under the carpet and we go back to business, as usual. >> b.a.r.t. responded with a statement which reads in part b.a.r.t. police was notified within an hour of the time the incident was reported and began an internal investigation that same night, an allegation that the workers were ordered to return to work is completely inaccurate. vick lee, abc 7 news. >> as you might have guessed, california's historic drought is getting worse. officials say the state has never been as dry as it is right now. abc 1 news meteorologist sandhya

patel with the details. >> yeah, larry, it's really bad. we 'parched. take a look at the latest on the drought monitor. last week 36% of the state which included central and southern california in an exceptional drought indicated by the marine, extreme drought in red. now, this week as we bring you up to present time, 58% of the state is in that d will be 4 exceptional drought category which includes napa and sonoma counties. it just keeps getting worse. three dry years. the soil moisture is being depleted, of course, and this drought is continuing to worsen. it doesn't look like any moisture in the forecast. we have some sizzling summer weather. i'll be back with the details on that in a few minutes. sheryl? >> thank you. health officials are warning people it avoid swimming at three beaches because of high bacteria levels. beaches are all in the santa cruz area. both of the main beach off boardwalk and santa cruise's cowell peach is affected. now this may be because an

pushed all his chips right into the center and it's all or nothing. >> a's fan, can't have tears. it happens too many times. >> news that the a's traded star outfielder yoenis cespedes to the boston red sox for jon lester and former bay area native jonny gomes came as a surprise. >> billy beane is making a push for the world series. got a get on board. >> cespedes is a huge fan favorite with great numbers known for being a slugger at plate. as soon as the news broke josh reddick had some fun posting this tweet, our rotation with the link to the dramatic chipmunk. this is cespedes earlier this month winning the all-star home run derby for the second year in a row. he's also known for his rocket arm. a's fans will miss plays like this against the angels last june. fans credit that throw for saving the game. unfortunately, we've come up short twice in the past two

a 23-year-old woman is recovering after she was shot while sleeping in her home in antioch this morning. gunshots rang out at 4:00 a.m. this was on west fifth street a block away from the police department. as abc 7 news reporter amy hollyfield explains, the gunmen are still on the loose >> reporter: bullets pierced the window and front door of this apartment unit on west fifth street in antioch at 4:00 this morning while two generations of one family slept inside. >> it's scary. i was, like, man, it hit the door and went right through? this young man's father did not want his son's face showed on tv because he's worried the gunman will come back. a 23-year-old woman, this man's sister-in-law, was hit by the gunfire. >> we were all sleeping and just woke us up and she got grazed.

>> reporter: sometimes the young grandchildren sleep here, too, but they were not here at the time of the shooting. antioch police have not made any arrests. they told us they don't think the shooting was random, but that this apartment unit was target. they won't say y.family though believes it was random and just part of life in antioch. >> i'm kind of used to all this because antioch, this is like a daily thing. i hear gunshots every night, whether around here or down the street. we hear it, but this time i guess it was aim at our building. >> the family of the victim says she is going to be okay. she went to the hospital to get some stitches. antioch police have not released any information about possible suspects. in antioch, amy hollyfield, abc 1 news. >> suspended state senator leland yee pleaded not guilty in federal court today to a long list of charges. prosecutors unsealed an expanded grand jury indictment that includes a new racketeering charge which accused yee of soliciting bribes and gain

contributions in exchange for political favors and being part of a chinatown gang. today's indictment supercedes the original charges filed back in april. he is now charged with 11 felonies, including ten counts of corruption and bribery. he's free on a $500,000 bond. >> napa's fire department is warning drivers tonight. they say somebody is punk touring gas tanks and then draining them. there's been multiple reports of this happeningest past week. move of the vehicles involved here are suvs or pickup trucks, probably because they are high off the the ground so the tanks are easier to reach. they also contain a lot of gas. the incidents are happening during the day and at night on quiet streets and even in busy areas. >> a battle is under way in walnut creek over who is responsible for removing a fallen tree. that tree fell across a private driveway. workers cape out and chopped up the part that was blocking street but said the homeowners would have to clear the rest but the home owners say that tree is rooted in a public creek. the county claims the creek is
